Counterfeit and grey market goods are a billion dollar industry.   A majority of counterfeit goods have the ability to pose a serious risk and possible injury to consumers.   Similarly, grey goods that are “materially different” violate the Lanham Act and thus cannot be sold in the United States.   For the trademark owner and U.S. distributor, this translates into lost revenue.

At Momentum, we can assist in identifying the counterfeited or grey product, conduct a test purchase, review products for authenticity, and investigate the parties involved to uncover the source of origin.  By accessing shipping records, we can track the importation of the product into the U.S. If the infringing product traces back to a manufacturer in Asia, we have the capabilities to further the investigation there and stop it at the source.   For each investigation conducted, we provide a comprehensive report along with exhibits.

We bill hourly for counterfeit investigations or as a flat fee on a case-by-case basis.
